1. General

These terms cover all use of the Find My Agent website and services provided by FindMyAgent Limited. By using our website or service you agree to them. We may update these terms at any time; changes take effect when posted on this page. These terms are governed by the laws of New Zealand. If any provision is found invalid it will be severed and the remaining terms continue in full force.

2. Our service

Find My Agent is a service provider to property vendors. We recommend a real estate agent or agents for the vendor to meet, based on our analysis of market and agent performance data and the vendor's stated requirements. There is no cost to the vendor and no obligation to meet or work with any recommended agent.

Find My Agent is not a licensed real estate agent or agency and does not take part in the marketing, negotiation or sale of any property. Any listing agreement you enter into is between you and the agent or agency, not Find My Agent. We are not responsible for the performance, timeliness or quality of any agent's services.

Our recommendations are made with care, but we cannot guarantee the completeness, quality or accuracy of the data available to us, or that an agent will accept a referral at the time of your request.

3. Independence

We are paid a referral fee by the agent when a property we referred sells. Vendors never pay us. Agents cannot solicit vendor referrals through Find My Agent or pay to be recommended; each recommendation is made using an independent and impartial selection process based on market and agent data.

4. Complimentary marketing

Where a vendor lists with a recommended agent, we may set up a complimentary social media campaign for the property. The recommended agent agrees in advance that Find My Agent may run such a campaign on the agent's behalf using material sourced solely from the agent's current advertising. The scope, platforms and duration of any campaign are at our discretion, and we may withdraw or change the offer at any time.

5. Privacy

We collect and use your personal information as described in our Privacy Policy. We will not pass your details to an agent without your go-ahead. You may request access to and correction of your information at any time.

6. Intellectual property

All content on this website — text, graphics, logos, data and software — is owned by or licensed to FindMyAgent Limited unless otherwise stated. You may not copy, reproduce, distribute, adapt or commercially exploit any material without our written permission, except for personal, non-commercial use.

7. Liability

Our website and service are provided on an "as is" basis and your use of them is at your own risk. To the fullest extent permitted by law, we exclude liability for any direct, indirect, consequential, special or exemplary loss or damage, including loss of data, income, profits, business, opportunity or goodwill, arising from your use of our website or service or any agent we recommend. If we are found liable, our total liability to you for all claims, whether in contract, tort or otherwise, is limited to NZ$2,000. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.

8. Indemnity

You agree to indemnify FindMyAgent Limited against all claims, costs, losses and expenses arising from your breach of these terms or your misuse of our website or service.
